Additional FEES That May Apply

Below is a summary of the fees and charges that may be payable by you in addition to the rental fee under a MrFixed Agreement. Full terms and conditions on fees and charges are set out in the MrFixed Agreement.


1.1     Early Termination Fees


1.1.1    Early termination fees are the fees and charges payable if you end a MrFixed Agreement that you have entered into with us before it is due to expire and consist of:

 

  1. the rental payments and other amounts that are due but have not been paid;

  2. as liquidated damages an amount which is the lesser of:: a). six (6) months rental payments, or b). the balance of the rental payments payable to the expiry of the agreement;

  3. any amounts payable listed below including late payment fees;

  4. any enforcement expenses incurred, including any costs reasonably incurred by us in taking possession of the Goods and storing them; and

  5. where the Goods have been damaged, the cost of repairing the Goods or the replacement value of the Goods

 

1.2      Late Payment Fees

1.2.1  If we do not receive your rental payment on or before the day it is due, then it will be late and we will charge you a late payment fee.

If your payment is late more than once, the fee we charge increases in line with the table below.

First late payment $10.00 You pay this amount to cover us for:any bank fees we incur a result of a direct debit dishonor; andour administrative costs in reviewing your account, contacting you by telephone and sending you a letter about the late payment.
Second late payment $20.00 You pay this amount to cover us for:any bank fees we incur a result of a direct debit dishonor; andour administrative costs in reviewing your account, contacting you by telephone and sending you a letter about the late payment and notifying you in person about the late payment.
Third late payment and any subsequent late payments $35.00 You pay this amount to cover us for:any bank fees we incur a result of a direct debit dishonor; andour administrative costs in reviewing your account, contacting you by telephone and sending you a letter about the late payment, notifying you in person about the late payment and contacting your referees.

1.3     Loss or Damage or Heavily Soiled

1.3.1  You are responsible for all loss or damage to the Goods.

1.3.2   In addition, you are responsible when the Goods are Heavily Soiled. "Heavily Soiled" is defined as excessive soiling beyond regular usage that would be considered reasonable under the circumstances.

1.3.3   If the Goods are lost, damaged or heavily soiled you must pay the Replacement Value or pay the cost of repairing/cleaning the Goods. We will decide whether the Goods can be repaired/cleaned or whether they must be replaced. Also, you must continue to make Rental Payments to us. You must tell us as soon as possible about any loss, damage or heavy soiling to the Goods and also provide us with a written report.

1.4     Security Bond

1.4.1  If we ask for one, you must pay a security bond to us on or before the date the Goods are delivered to you. The security bond may be used to pay money you may owe us under an agreement and/or to cover the cost as outlined in section 1.3.
